It's only stupid if Gonzales were at any risk of being prosecuted for his crimes. I think it's a given that nothing will come of this investigation.
What would they investigate exactly? This weakened our Justice Department, was clearly immoral and partisan, and reeks of the idiocy of the Bush administration. But they can hire whomever they please. What was illegal about it?
Actually, there are laws against it. Not only does it violate federal Civil Service laws, but also Gonzalez could be tried for perjury since he's previously denied he did so in front of Congress and under oath. Furthermore, any DOJ officials that did this could also be disbarred.
The shame is that beyond the perjury case, there's really no criminal prosecution avenue here. But now the DOJ is stacked with a bunch of right-wingers who got their jobs because of their political affiliation and this calls into question the impartiality of the DOJ in future cases stretching from voter fraud to civil rights. In essence, the neocons are going to be rewarded in the long term for breaking the law and lying about it.
They weren't dumb enough to ask you if you were a conservative at the interview, but if your resume didn't have the Federalist Society on it, your prospects were pretty grim.
