San Francisco to Sue California Over Gay Wedding Ban

SAN FRANCISCO (Reuters) - San Francisco, currently defying California by marrying same-sex couples, plans to sue the state to overturn its law defining marriage as only between a man and a woman, the city attorney's office said on Thursday.

"We're filing the lawsuit in San Francisco this afternoon," Therese Stewart, a member of the city attorney's office, told Reuters.

She said the suit will be filed against the two conservative family values groups that sued San Francisco to stop it from issuing wedding licenses to same-sex couples and against the state of California over its ban on gay and lesbian marriages.

The lawsuit will come just over a week after a decision by San Francisco Mayor Gavin Newsom to allow the issuance of same-sex marriage licenses in defiance of state law.

The mayor's move -- which has resulted in about 2,800 same-sex marriages so far -- has been criticized by President Bush and many others who believe marriage should be only between a man and a woman.

Stewart said the lawsuit argues that parts of California's family code provision prohibiting same-sex marriage are unconstitutional under California's equal protection clause.

The attorney added that the suit would also take aim at Proposition 22, an initiative that became law in 2000 after voters overwhelmingly approved it. The measure restricts marriage only to heterosexual couples.

Stewart said the lawsuit, to be filed in state superior court, would be filed as a "cross complaint" so that it could be folded into lawsuits filed previously against the city by the Alliance Defense Fund (ADF) and the Campaign for California Families (CCF).

Addressing the ADF's lawsuit, California Superior Court Judge James Warren on Tuesday asked San Francisco to "cease and desist" from issuing more marriage licenses but refused to order a stop to the marriages until he heard legal arguments on March 29.

A second California judge, Robert Evans Quidachay, on Tuesday delayed a hearing until Friday on another lawsuit challenging the decision to allow same-sex marriages.
This is getting out of hand. I hope those licesnes mean something once the courts are through, but who knows at this point?

Anyway, back on topic. I'm unsure whether this whole SF Marriage deal will help or hurt the Gay Marriage cause. If the courts shoot down what SF is doing, it'll be a lot harder for other cities/states to create their own gay marriage laws. If it passes through the courts, the conservatives will cry for blood, and bring in Dubya.

Personally I don't see a problem with gay folks getting married, but what do I know? ;)

Oh, you are speaking to me. I was thrown off by Bitterman's poor attempt at humour.

You make claims that would make one think that you would know more about Chinese history than myself. What exactly is there in Chinese history that would lead you to believe that my beliefs are incorrect and yours correct in regards to gay marriages? Mohism certainly has it's place in Chinese history and thought, however, it is not the prevalant thinking nor the most influential. You have shown a textbook knowledge of Chinese thought, however, it is still far from the realities of living the life and culture.

Dirt... I was speaking to you as a Chinese-American, not Chinese. Your group suffered through the exact same kind of bullshit that you'd like to inflict on gays. And I specifically said that it wasn't knowledge that you lacked, but rather the perspective that that knowledge should give you. But whatever. This really has gotten old. You even said that you have lousy reasons for holding onto your belief, yet you hold onto it. That smacks of dogmatism, and although there is a strong dogmatic strain within Chinese culture, it's one of the less noble strains within that culture.
