San Francisco to Sue California Over Gay Wedding Ban

SAN FRANCISCO (Reuters) - San Francisco, currently defying California by marrying same-sex couples, plans to sue the state to overturn its law defining marriage as only between a man and a woman, the city attorney's office said on Thursday.
"We're filing the lawsuit in San Francisco this afternoon," Therese Stewart, a member of the city attorney's office, told Reuters.
She said the suit will be filed against the two conservative family values groups that sued San Francisco to stop it from issuing wedding licenses to same-sex couples and against the state of California over its ban on gay and lesbian marriages.
The lawsuit will come just over a week after a decision by San Francisco Mayor Gavin Newsom to allow the issuance of same-sex marriage licenses in defiance of state law.
The mayor's move -- which has resulted in about 2,800 same-sex marriages so far -- has been criticized by President Bush and many others who believe marriage should be only between a man and a woman.
Stewart said the lawsuit argues that parts of California's family code provision prohibiting same-sex marriage are unconstitutional under California's equal protection clause.
The attorney added that the suit would also take aim at Proposition 22, an initiative that became law in 2000 after voters overwhelmingly approved it. The measure restricts marriage only to heterosexual couples.
Stewart said the lawsuit, to be filed in state superior court, would be filed as a "cross complaint" so that it could be folded into lawsuits filed previously against the city by the Alliance Defense Fund (ADF) and the Campaign for California Families (CCF).
Addressing the ADF's lawsuit, California Superior Court Judge James Warren on Tuesday asked San Francisco to "cease and desist" from issuing more marriage licenses but refused to order a stop to the marriages until he heard legal arguments on March 29.
A second California judge, Robert Evans Quidachay, on Tuesday delayed a hearing until Friday on another lawsuit challenging the decision to allow same-sex marriages.
This is getting out of hand. I hope those licesnes mean something once the courts are through, but who knows at this point?
