I'm looking for a action title with stat and ability development.
Something like Crackdown, or Prototype, or even Red Faction
Other element I enjoy (but not required)
Destructability
Open World
Super Hero themes
Games like this I've tried and enjoyed
Crackdown
Prototype
Red Faction: Gurellia
Iron Man
Any others? Must haves? Good ones? if none of those how about something thats just rental worthy :)

The Incredible Hulk - I think it got a lukewarm reception but I liked it (mind you, I never played HUD).
Spiderman Web of Shadows is decent.

It's got everything you asked for, including the ability to destroy any building in the game.
Look at the Prototype Review thread. On the last page (or second to last at this point?) I directly compare Prototype to Hulk.

Saint's Row 2, off the top of my head. It doesn't exactly have stat development, but it has a constant flow of abilities and in game rewards that are useful. If the stories and settings in the games you list didn't bother you much, SR2's setting should be fine and the violence, coop gameplay, and level of player rewarding action are great.
Mercenaries 2 will seem lackluster in many ways after you've played RF:G, but I still got a lot out of it both in singleplayer and in the fantastic coop. Again, more ability unlocking than stats.
The last three open world games I'll recommend all at once: Scarface, Godfather (1 only), and Just Cause, in that order. They are dated as hell, but each has core mechanics and/or gimmicks that are tremendously addictive. Scarface has a movie license that finally works perfectly for the game that is built around it, and fantastic, simple terrain control that works well. Smuggling drugs in a cigarrette boat never felt so good. Godfather has a different take on the turf war aspect, with gratifying violence/intimidation mechanics and such ludicrously poor use of the movie license that it's almost B movie funny. Almost. Finally, Just Cause has a grappling hook and a parachute. Sounds like nothing, but once you get the hang of it that is all you need to rationalize away the many deficiencies of the game.
All of these games have lengthy individual and combined threads here, filled with more info if you are interested. Many should be dirt cheap.

I'm looking forward to Overlord 2, which is coming out pretty soon. You could rent the first one to get a taste of it, or just try the demo. Not a sure thing of course, but it sounds like they've ramped up the castle building and RPG aspects of it.

I just rented Mercenaries 2 and it didnt have anything along the lines of stat or ability evolution. What I like most about these games is the ability to evolve my character and making choices that effect play...iei building up abilities and stats that effect play. Red Faction does it in a wierd kind of way, and of course Crackdown was a dream! It was the only thing that kept me playing Prototype frankly!
I did play Mercenaries 2 a bit though and it was kind of good...with the money and oil and equipment you can buy, but the lack of evolving the character and his ability to function in the world just kept me from getting totally thrilled for it.
Same for The recent Hulk game. It opens up new powers as you finish missions, but it doesnt give you much in choosing your own path or evolution.
I heard Xmen Orgins: Wolverine gives you that, and based on the thread here...I may go from rent to buy on it. :) I'm just wondering if I missed some earlier games or other recent games with these kind of character evolution and choice.

Hmm Just Cause was already on my radar, so I think Scarface will defintly get added as a result of your rating here. If it clciks with my particular tastes Ill definetly add Godfather for a peak! :)

If direct stat building and development paths are what you are after primarily, then I don't think very many of the games I mentioned are going to work. I was focusing more on the open world/violent chaos aspect. Godfather I does have stats you put XP into, but they are not meaningful in the way that a superhero game like Crackdown does it, and more in keeping with the gradually scaled abilities that most sandbox games adopt in some form. SR2's cartoonish powers and integrated cheats (eg what most games would have as a cheat is an integrated reward for succeeding in activities) might work, but it would take some adapting on your part.

I dont need massive impact, i enjoy many strategy and rpgs where development of characters is minor , like Original War, for the PC. That was a strategy game but i really enjoyed the ability to subtly improve character development and having choice on how do to it. :) I LOVE Red Faction and it has very limited choice for character development, yet it handled it in a very satisfying way. I'm really tempted to give SR2 a go...just because of the goodwill they earned with Red Faction. While I'm at it, ill Godfather to my Blockbuster list :)
