IIRC, You don't have to be drunk at all. They aren't required to do a breath test for a drunk in public charge. You just have to be acting in a way that the a sober person wouldn't, as judged by the person arresting you.

You must not know anybody in California, where the state legislature forbids charging a second-time DUI (or a third-time DUI, for that matter) as a felony. They must be charged as misdemeanors as a matter of law. Fourth-time DUIs can be charged as either a felony or a misdemeanor, at the prosecutor's discretion.

Sounds like a device level problem. Maybe she has a driver issue. Have you tried modprobing her instead of mounting.
