Take Two claims that Thompson is misusing Florida's "nuisance" law, and they point out that attempts to regulate the sale of violent video games have repeatedly faltered, including cases in which the law was drafted by Thompson himself.
This could be good.

IANAL, obviously, by the following question:
What level of complete asshattery must a lawyer sink to before the Bar Assoc. takes action? How is JT still a licensed, practicing attorney?

I thought they were trying (http://www.informationweek.com/news/showArticle.jhtml?articleID=197003885) for various reasons.

Here's hoping Jack's as bad a defender as he is a prosecutor.

This guy needs to keep his beliefs out of our games. If violent cartoons and games were responsible for people going crazy and shooting each other, how come our generation didn't do it? We had the Road Runner, Bugs Bunny, Tom & Jerry, etc. all of which contained violence.

Didnt your generation also had Ted Bundy?

At least the Florida Bar rejected Bundy.

Thompson Responds (http://arstechnica.com/journals/thumbs.ars/2007/03/17/jack-thompson-responds-to-the-take-two-lawsuit)
Holy shit, it never ceases to amaze me how the media in the US allows nutters to get so much exposure.

Great.
I didn't realize he was a BTL.
If we just ignore him, won't he go away?
I mean he's on his 16th or 17th minute of fame, shouldn't someone pull the damn plug already?

We have to keep paying attention to him. Otherwise he might go off the deep end and kill people. If no one gives him attention, who knows what might happen!
And then of course blame all those video games he had to play all the time in order to bring the lawsuits he brings against Take 2.

Thompson files a totally batshit counterclaim! (http://gamepolitics.com/2007/03/22/in-countersuit-thompson-claims-take-two-at-center-of-vast-rico-conspiracy/)

Thug porn...
Mugger: Gimme your purse, lady.
Woman: No, but I'll give you... something else.
(Woman starts undressing. Sax music begins.)
From the link:
Take-Two has, since July 2005, been at the center of an effort to violate Thompson’s civil and constitutional rights… In addition to… extortion (intimidation) of Thompson… Take-Two has committed other predicate RICO acts, including but not limited to fraud, distribution of obscene and/or sexual material harmful to minors…
IANAL, but doesn't a court have to find something "obscene" before it can be legally classified as such?

You can say all kinds of wacky stuff in a court filing like this one. Doesn't make it true.
I skimmed it. IANAL, of course, but I've worked on plenty of litigation. I wish I could say it's the worst pleading I've ever seen, but it isn't - he appears to at least have a basic grasp of the English language. His tendency to go off on long rambling tangents that appear to have nothing to do with the defense or claim he's asserting sure is amusing, though.

It's not that bad. If I were representing Take Two I'd have sued him for champerty, but that's just me.
The worst pleadings in America jurisprudence are drafted by Amanda Ajuluchuku. (http://courier.evansville.net/news/2006/may/27/getting-rich-woman-has-filed-frivolous-trillion/?printer=1/)

Mostly I think it's a silly pleading because in my experience you use your answer and counterclaim to state your defenses, state your claims, and that's pretty much it. Save the argument and detailed descriptions for summary judgment. But again, I'm not a lawyer, and maybe it's different in Florida.

That depends on who the audience is. When I answer complaints, my model is admit, deny, and deny for lack of information sufficient to form a belief as to the truth of what's asserted. I throw in a few Rule 12 motions and one sentence affirmative defenses. I keep my counterclaims short, with just enough detail to survive Rule 12(b)(6). But I'm writing for an audience of one judge, or three if it gets that far.
Thompson isn't. He's writing for judges and for the media. Specifically, for the media that promote killer sharks, lacrosse rapes, Aruban kidnappings, and crimes sprees fueled by videogames or Dungeons and Dragons.
I think his pleadings serve him well.

Huh. Yeah, when you put it that way it makes sense.
