Well that time has come again where I'm getting rid of more games. Much as I love old games there are some that I know that even if provided with infinite time I wouldn't play just because there are games I love oh so much more so on the list to give away this time are:
Madden 2004 PC
Disciples II rise of the elves
Age of Wonders
Arcanum
Cossacks
America and the expansion pack
Risk
Risk II
Season Ticket Baseball
Soulbringer
If you would like any of these just post here DONT pm me, it's easier for other people to see what's taken and what's not if it's posted in forum and I don't have to compare times and who asked first. I can't promise how fast I'll ship because I'm working 28 hours of overtime this week and 20 next but I do have a week of vacation the next so look for me to ship sometime around Feb 1st.
Warning: If no one speaks up for soulbringer this time I'm going to put it in a random package cause I want it out of my house. I'd sell it as possessed and evil on e-bay but I don't want to pay the quarter listing fee.
Like before send me money for shipping and handling if you can and want, I'm not gonna harrass any Q23er for cash for a 75 cent envelope and media mail shipping.

I figure you don't send international, but guys, Soulbringer is really no bad game. Sure, it's quite strange that every opponent fights with a weapon (yes, including stone golems... with a wooden club), but you won't feel the sensation of getting insanely powerful as intensive as in Soulbringer anywhere else. Fun story, too. And it's free!

Soulbringer's controls are pathetic.
I don't recommend Soulbringer to any but the most devout RPGers. The game will foil your plan to like it by making it impossible to properly move your character.

Presumably he's not sending out burned copies. What's wrong with giving a game you purchased to another person?

Doesn't every EULA under the sun specifically prohibit it? Remember, the games you buy aren't your property. You paid only for a limited restricted permission to play the game.

Hmmm.... well to totally derail the topic then what about a game that I purchase with the intention of giving it to someone? Or maybe I purchase the game, remove the shrink wrap but then immediately hand it to someone? Or maybe I open the box then give it? Or maybe I install it and delete it immediately without ever playing it then give it away?
At what point did I cross the line? Is the purchaser automatically the one to whom the license applies?

If the person who bought the game doesn't have a burned copy of it they're keeping, and if they're handing the game off, and if they don't have a version of it on their hard-drive, aren't they transferring the license? In what significant way, precisely, is this any different from EB selling used games?
I thought nowadays we had to get permission from the company who made the game, send the disks back for replacement, and pay an extra $10 in order to transfer ownership of a game we bought.

I've wondered the same thing about retailers selling used games. They must kick back to the publisher when they do that; otherwise it seems like it'd be no different than people charging others for downloading files off of them via Kazaa.

I know some Qt3ers are current/former EB games employees, but I'm betting there is no kick back. Realize that under such a system, the original owner of the game also would be obligated to kick back a portion of the money EB pays the owner, because the game is changing hands twice: original -> EB -> new owner. I can't believe this is what's done.
I've never downloaded a file off of Kazaa, but that action results in an additional copy of the file being created That's a much clearer possible violation of copyright than this case, where one original copy of the media is simply being transferred between owners.
Actually I met a guy last week who buys "used" games in bulk from large retailers like Best Buy who don't sell used games, then resells them to EB. Apparently he siphons off unwanted stock and/or returns and makes a couple bucks profit off each game.
I didn't understand exactly how this worked, because I thought returns and unwanted stock just got sent back to the distributor/publisher, but he said he had "connections" which allowed him to do this.
I asked him what he was going to do if all games went the way of Half Life 2, and he predicted that Valve would fail in their distribution schemes. I guess he had to believe that.

They only have the right of first sale, same as music cd's sold used, pubs get nothing.

I'm sorry to have jacked the thread, yurislave, but it just made me think... like I told another user who pm'd me about this, I always wonder if I'm violating someone's rights when I share games I like with people in hopes of proselytizing them. Not really worried so much about getting caught and punished, but I just would rather not do something that is detrimental to the folks who work hard to develop things that cause me to be late for bed and work.

Like much of marketing and coporate strategy, this is complete bullshit.
The licensing thing is what they would like you to believe, not what is actually true. EULAs have still not been effectively tested in court, and the one big case (Adobe v someone) was a blow against the "licensing" scheme.
The fact of the matter is, software is just another form of property at the moment, plain and simple. Reselling it is perfectly fine. EULAs are crap, and we should strive to keep it that way.

Here's some sample language from the EULA of neverwinter nights:
You may permanently transfer all rights Infogrames grants to you in this License, provided you retain no copies, you transfer all of the Software (including all component parts, the media and printed materials, the CD-authentication key, and any upgrades), and the recipient reads and accepts this License.
I'm not a lawyer but I assume I can give away my original game copies as long as I'm not keeping burned copies and they've been uninstalled. Most EULAs include a clause just like this one.
